WHAT IS MEDICAL NEGLIGENCE?

Medical negligence is the one element of a medical malpractice claim. Medical negligence would be the doctor owed the patient a duty but breached that duty because he didn’t meet the medical standard, that would be medical negligence.

Now, mere medical negligence does not mean you’re injured nor does it mean you’re going to have a successful malpractice claim. You have to have the medical negligence coupled with the injury and there has to be a causal connection between the two. The doctor if he misdiagnosed that you have cancer or heart disease and nothing happens to you, that’s just mere negligence. If you ultimately die, that’s medical malpractice.
