WHO IS THE CLAIMANT IN AN AUTO ACCIDENT?

The claimant in the auto accident is the individual that was not at fault in that accident. They originally start off as a claimant because they come to our office and we assist them with obtaining a compensation for their loss wages or their medical bills. We send the claim to the insurance company of the at-fault driver. After we send that claim to the insurance company, the insurance company either accepts the claim or denies the claim. If the insurance company subsequently denies the claim, then the claimant, their title changes from claimant to plaintiff.
